Counterfeit goods from China: what it costs a Nigerian importer

Counterfeit goods from China sit on Nigeria's absolute prohibition list, and forged trademarks are a criminal matter. The scale, the law and the defence.

Counterfeit goods from China are the easiest money in Nigerian importing and the fastest way to lose a business. The trade is enormous, the goods are cheap, and the market absorbs them. What most importers do not know is that counterfeits are not a customs irregularity in Nigeria; they sit on the absolute prohibition list, and dealing in goods bearing forged trademarks is a criminal offence with imprisonment available. This page is the scale, the law and the practical defence.

How big is it? #

A report by the DAWN Commission dated 14 May 2026 estimated that counterfeit goods make up around 40 percent of products in the Nigerian market, and put the annual loss to substandard and counterfeit goods at around 15 trillion naira, roughly 19 billion dollars. It named Lagos markets including Alaba International and the Trade Fair Complex as the epicentre, and estimated 85 to 120 billion naira a year in uncollected VAT, duties and corporate tax.

On the regulated side, NAFDAC stated in June 2026 that cosmetics, food and beverages together account for over half of counterfeit products found in Nigeria, and described counterfeiters using online ordering and cargo groupage for goods manufactured abroad, particularly in Asia.

So this is not a fringe problem. It is a substantial part of what moves through the same containers your goods travel in.

The law, plainly #

Customs. Counterfeit and pirated articles are on the absolute prohibition list under the Nigeria Customs Service Act 2023, which gives Customs seizure authority. Not a fine and release. Seizure.

Criminal. The Merchandise Marks Act makes it an offence to sell or possess goods with forged trademarks. On indictment the penalty runs to imprisonment of up to two years, with forfeiture of the goods; on summary conviction a shorter term applies. There is an innocent dealing defence for a person who took reasonable precautions and can identify the supplier they bought from, which is the single best argument for keeping every invoice, every contract and every copy of a supplier's business licence.

The wider framework. Nigeria has no single anti counterfeiting statute, but the Trade Marks Act, the Copyright Act 2023, the Customs Service Act 2023, the Merchandise Marks Act and the Federal Competition and Consumer Protection Act 2018 all apply, enforced variously by Customs, NAFDAC, SON, the police and the consumer protection commission. Civil remedies include seizure, forfeiture, destruction orders, injunctions and damages, with the importer bearing detention, storage and destruction costs.

That last clause deserves its own sentence. If your container is seized and destroyed, you pay for the storage and the destruction. The loss is not capped at the value of the goods.

Where the line actually falls #

This is the part that confuses honest importers, because three things get called the same thing.

Generic, unbranded goods. A cable, a brake pad, a handbag with no brand on it. Completely legal. This is the largest part of Chinese manufacturing and it is what most Nigerian importing should be.

Your own brand on a generic product. You commission a factory to make a product and put your name on it. Legal, sensible, and the route to a business worth more than its stock. Our private label page touches on it.

Somebody else's brand without authorisation. A cable in a known brand's packaging, a phone made to look like a flagship model, a bag with a luxury logo. This is the criminal category, and no amount of "everybody does it" changes what the Act says.

The grey area people ask about: a genuine branded product bought from a Chinese wholesaler rather than the brand. If it really is genuine, it is genuine, but proving that at a Nigerian port is your problem, and a brand authorisation letter is what proves it. If the supplier cannot produce one, assume the goods are not what they say.

The practical defence #

  1. Buy unbranded, or buy your own brand. This single decision removes the entire risk. It also builds something you own.
  2. Demand a brand authorisation letter for anything branded. A real distributor has one and produces it in minutes.
  3. Verify the supplier's business licence, check that the company registered is the company selling, and keep a copy. Our supplier checking page covers it and our supplier scams page covers the rest.
  4. Treat a price well below the floor as information. A product has a cost made of material and labour. Well under it means the brand was the only thing being copied.
  5. Ask for test reports in the manufacturer's own name, not a trading company's.
  6. Use a pre shipment inspection. Our inspection page covers it. An inspector opens the cartons in China, where the problem is still fixable.
  7. Keep every document. Invoices, contracts, licences, messages. That file is what the innocent dealing defence is made of.

The other reason not to #

Set aside the law for a moment.

A counterfeit brake pad does not stop a car. A counterfeit charger burns a house. A counterfeit cosmetic containing mercury or hydroquinone, both prohibited in Nigerian cosmetics, damages the person who bought it. NAFDAC destroyed a reported 1.5 trillion naira of fake products in the twelve months to June 2026 and secured 64 convictions with sentences from twelve months to seven years.

The trader selling those goods in Aba is not an abstraction in that chain. He is the last person who could have stopped it, and under Nigerian law he is also the one holding the goods when the officers arrive.

What this means for your product choice #

Some categories are simply harder to buy cleanly than others. Branded electronics accessories, branded auto parts, designer fashion, branded cosmetics and branded phones are the four where the counterfeit share of what is offered to you is highest. Our auto parts page and phone page deal with those specifically.

Counterfeit goods from China cluster in branded categories; the ones where clean buying is easy are the unbranded ones: components, materials, packaging, plain goods you brand yourself, machinery. They are less glamorous and they are where the durable Nigerian importing businesses actually are. Our product selection page works through the choice.
